Under Myanmar employment law, employers must enter into a written employment agreement with each employee by no later than 30 days after commencement of employment. The employment agreement must be registered with the local office of the Ministry of Labour, Immigration and Population (MLIP). It is actually technically a crime for employers to fail to register a written employment agreement (although we are not aware of anyone having been charged with this offence).

The MLIP has also produced a template employment agreement and introduced regulations that make the use of this template mandatory. However, additions and variations to the terms of the template can be made via the use of an addendum or annexure.

We are experienced in completing and registering MLIP template employment contracts. In addition, we can assist you with drafting a template employment contract addendum to customize the terms of the MLIP contract to the standard or preferred terms for your business, or help you with drafting a specific new addendum for a particular hire. We can also advise you on the application of minimum employment standards and conditions in Myanmar based on the terms of the MLIP contract and other applicable legislation – including assisting with a review your company’s HR processes for Myanmar employment law compliance.

When the employment relationship ends, we can advise on and assist with: the appropriate notice requirements for employment termination; informing relevant regulatory authorities; and recommended steps in the employment termination process. We can also advise on the compulsory severance pay entitlements that apply under Myanmar law based on length of an employee’s service and assist with calculations of final employee benefits.
